BSG Nexus Discord Bot Service

These Terms of Service govern the use of the BSG Nexus Discord bot service (hereinafter "Service"), operated by Tobias Lange (hereinafter "Provider").
By inviting the bot to a Discord server or using the web panel, the user or server administrator (hereinafter "Customer") agrees to these Terms of Service.
(1) The Provider grants the Customer access to a Discord management bot including a web-based control panel.
(2) The Service includes: - Automated game selection and event pipeline for Discord servers - Warning system, notes and announcement features - Web-based management panel with Discord OAuth login
(3) No claim to specific features or uninterrupted availability exists unless agreed upon separately in writing.
(1) Use of the Service requires: - A valid Discord account - The "Server Administrator" role or equivalent permissions on the respective Discord server - Compliance with Discord's Terms of Service (discord.com/terms)
(2) The Service is intended exclusively for adults and legal entities.
(3) Sharing web panel access credentials with third parties is prohibited.
(1) The Customer agrees not to use the Service for: - Violations of applicable law or Discord's Terms of Service - Harassment, threats, or discrimination against individuals - Distribution of unlawful, offensive, or harmful content - Automated mass processing or spam
(2) The Customer is responsible for all content processed through the Service on their server (e.g. announcements, notes, warning reasons).
(3) The Customer shall indemnify the Provider against all third-party claims arising from unauthorized use of the Service.
(1) The Service stores the following data to provide its functionality: - Discord Guild IDs and configuration settings - Discord User IDs (for cooldowns and warnings) - Content entered by the Customer (game names, warning reasons, notes, announcements) - An activity log of web panel actions
(2) Discord message content is not stored.
(3) Data is not shared with third parties except where technically necessary to provide the Service (e.g. database hosting).
(4) After the bot is removed from a server, all associated data will be permanently deleted after a grace period of 30 days.

(1) The Provider aims for the highest possible availability but does not guarantee uninterrupted service.
(2) Maintenance, updates, and unavoidable outages do not entitle the Customer to any reduction or termination of service unless a separate Service Level Agreement exists.
(3) The Provider reserves the right to modify, restrict, or extend features at any time.
(1) The Provider is fully liable for damages resulting from injury to life, body, or health, and for damages caused by intent or gross negligence.
(2) For minor negligence, the Provider is only liable for breach of essential contractual obligations. In such cases, liability is limited to foreseeable, typical damages.
(3) Further liability is excluded. In particular, the Provider accepts no liability for: - Data loss due to force majeure or third-party attacks - Damages from unauthorized use of the Service - Loss of profits or indirect damages
(1) The Customer may terminate the Service at any time by removing the bot from their Discord server.
(2) The Provider may suspend access or terminate the Service without notice if the Customer breaches these Terms.
(3) If the Service is discontinued, Customers will be notified with at least 14 days notice where technically possible.
The Provider reserves the right to amend these Terms at any time. Material changes will be communicated to Customers where possible. Continued use of the Service after changes constitutes acceptance of the updated Terms.
(1) These Terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods.
(2) The jurisdiction for all disputes is, to the extent permitted by law, the registered seat of the Provider.
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions remain in full force. The invalid provision shall be replaced by a valid provision that most closely reflects the economic intent of the original.
